These Terms of Service ("Terms") constitute a binding legal agreement between you and GSB SUN POWER CO.,LTD ("Company," "we," "us," or "our"), a private limited liability company incorporated in Thailand, with its registered office at 8/2032 Hua-Hin 126 Khao Tao Village, Nong Kae Subdistrict, Hua Hin District, Prachuabkhirikhan Province 77110, Thailand.
These Terms govern your access to and use of our mobile application, website, content, products, and related services (collectively, the "Services").
1.1 Acceptance of Terms
By accessing, downloading, or using the Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Services. These Terms expressly supersede any prior agreements or arrangements with you. We reserve the right to terminate these Terms or your access to the Services at any time, for any reason, without prior notice.
1.2 Amendments
We may update or amend these Terms from time to time. The amended Terms will be effective immediately upon posting. Your continued use of the Services after such posting constitutes your consent to be bound by the Terms as amended.
The Services provided by the Company encompass a network of Electric Vehicle (EV) charging stations and a digital platform (the "App") that allows users to locate, reserve, and operate these stations. This includes the functionality to add value to a pre-paid balance ("EV Charge Wallet") for the sole purpose of purchasing goods and services within our network.
2.1 License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the App on your personal device solely in connection with your use of the Services; and (ii) access any content and information made available through the Services, in each case for your personal, non-commercial use.
2.2 Restrictions
You agree not to: (i) remove any copyright or proprietary notices from the Services; (ii) modify, create derivative works based upon, distribute, license, sell, or otherwise exploit the Services unless expressly permitted by us; (iii) reverse engineer or decompile the Services; (iv) use any data mining, robots, or similar data gathering or extraction methods; or (v) attempt to gain unauthorized access to or impair any aspect of the Services or its related systems.
2.3 Intellectual Property
The Services and all rights therein are and shall remain the Company's property or the property of the Company's licensors. Neither these Terms nor your use of the Services convey or grant to you any rights: (i) in or related to the Services except for the limited license granted above; or (ii) to use or reference in any manner the Company's company names, logos, product and service names, trademarks, or services marks.
3.1 Registration
To access most features of the Services, you must register for and maintain an active personal user account ("Account"). You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to obtain an Account. You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to maintain accurate information may result in your inability to access and use the Services or the Company's termination of these Terms with you.
3.2 Account Security
You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times.
3.3 Network Access and Devices
You are responsible for obtaining the data network access necessary to use the Services. You are responsible for acquiring and updating compatible hardware or devices necessary to access and use the Services and the App. We do not guarantee that the Services, or any portion thereof, will function on any particular hardware or device.
4.1 Nature of the Wallet
The EV Charge Wallet is a closed-loop pre-payment facility. It is strictly limited to purchasing goods, charging services, or related services provided directly by GSB SUN POWER CO.,LTD.
4.2 Topping Up
You may add funds ("Top Up") to your Wallet using the payment methods available in the App (e.g., credit card, debit card, or QR prompt pay).
4.3 Usage and Insufficient Funds
The Wallet balance is used to settle charges for EV charging sessions and other goods. If a transaction exceeds your current Wallet balance, you must Top Up your account to cover the full cost before the service can be initiated or completed. All prices are inclusive of applicable VAT.
4.4 Fees
We reserve the right to pass on any transaction fees imposed by payment gateways or banks for Top Ups, which will be disclosed to you at the time of the transaction.
4.5 Refunds and Expiry
Wallet balances are generally non-refundable. In the event of an error in billing, please contact support. Promotional credits, vouchers, or gift balances transferred into the Wallet may be subject to specific expiration dates and terms.
4.6 Billing Disputes
If you believe there has been an error in a transaction or your balance, you must contact us immediately. We reserve the right to rectify any accounting errors or billing discrepancies.

6.1 Disclaimer
The Services are provided "as is" and "as available." The Company disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these Terms. We do not guarantee the reliability, timeliness, quality, suitability, or availability of the Services or that the Services will be uninterrupted or error-free.
6.2 Limitation of Liability
The Company shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Services, even if the Company has been advised of the possibility of such damages.
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the Arbitration Institute, Ministry of Justice, Thailand. The seat of arbitration shall be Bangkok. The language of the arbitration shall be Thai (or English, if agreed by both parties).
8.1 Notice
The Company may give notice by means of a general notice on the Services, electronic mail to your email address in your Account, or by written communication sent to your address as set forth in your Account.
8.2 Copyright Claims
Claims of copyright infringement should be sent to the Company's designated agent at the address provided in Section 1.
